INFORMATION NOTICE ON THE RIGHT OF WITHDRAWAL AND RETURN OF FAULTY AND NON-CONFORMING GOODS
Right of withdrawal
If you are a Consumer, you are entitled to withdraw from the contract, without stating a reason or incurring a penalty, within 14 (fourteen) days from when you or any appointed third-parties (i) receive the product or (ii) if several products on one order are delivered separately, from the date the last product was received.
To exercise a right of withdrawal, you should notify ProMarket, of your intentions by sending an explicit withdrawal declaration to ProMarket, using the contact form, or to the email address.
After sending your request, you will receive a withdrawal confirmation email with the returned materials form that must be included in the packaging and the instructions on how to ship the products. Remember to insert the completed RMA form in the packaging, together with the product, and send it within and no later than 14 (fourteen) days after receiving the confirmation email.
If you have received the product, please return it to ProMarket without undue delay and, in any event, within 14 (fourteen) days from the day you sent notice of your withdrawal. The deadline shall be met if you send back the goods before the period of 14 days has expired. You shall be responsible for the direct risks and costs of returning the goods and providing proof of the same. If you decide to exercise your right of withdrawal via the website using the return service provided by the website, before confirming the withdrawal request, the cost to return the goods will be indicated.
If you withdraw from this contract, we shall refund all payments received from you, excluding the costs of delivery without undue delay and in any event not later than 14 days from the day on which ProMarket receives the product and your decision to withdraw from this contract. We will carry out such refunds using the same means of payment as you used for the initial transaction unless you request the refund via a different means of payment, in which case you will be charged for any additional fees incurred as a result of your choice of such means. We may withhold the refund until we have received the returned goods or you have supplied evidence of having despatched the goods, whichever is the earliest.
You are liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. Therefore, if the returned goods are found to be damaged (for instance showing signs of wear, abrasion, nicks, scratches, deformation, etc.), not complete with all parts and accessories (packaging materials, boxes, documents and/or other contents included in the original package) unaccompanied by the instructions/notes/manuals supplied, the original packaging and packing and the original warranty, if any, the Customer shall be accountable for the decreased value of the product, and be entitled to receive a refund equal to the residual value of the Product. To this purpose, it is highly recommended you refrain from handling the product other than as strictly necessary to establish the nature, characteristics, and functioning of the same, and to use the original packaging of the Products plus further protective packaging that will keep them intact and protect them from writing or labels.
Returning nonconforming materials
The warranty period from the date of sale is defined by the legislation. The warranty does not cover spare parts, batteries, and the transmitter circuit, it does not cover any damage to third parties. No claims will be accepted regarding the damaged device (in any way), or without verification by the seller.
ProMarket does not cover the manufacturer’s warranty. All warranty and guarantees are provided by the manufacturer. If you have received a faulty and/or nonconforming product, you are required to report any defects and non-conformities of the products within and no later than 1 (one) months of acknowledging the same, sending the relative form to the Customer Care Service by email, clearly indicating the defect and/or non-conformity detected, along with the relative information indicated on the form itself (at least 2 (two) photographs of the Product, the order confirmation sent by ProMarket and/or the receipt).
On receiving the form and related documentation, ProMarket assess the nonconformity you reported via the website owner’s service center and, having carried out quality control tests in order to assess whether the product does not in fact conform, shall, at its own discretion, decide whether to grant authorization for the products to be returned, responding to your e-mail to the address provided by the Consumer when registering with the site or placing the order; this e-mail will include the “RMA Code” Authorisation to return the products shall, under no circumstances, infer acknowledgment of the nonconformity; this aspect will be assessed once the products have been returned. You shall send the products that ProMarket has authorized to be returned, together with a copy of the returned product materials authorization e-mail indicating the “RMA Code” within 30 (thirty) days from the date on which the nonconformity was reported to the address indicated.
In cases of nonconformity, you shall be entitled to have the conformity of the product reinstated with repair or replacement of the same by ProMarket, or alternate remedies in the cases expressly foreseen by art. 130 of Legislative Decree no. 206/2005.
If ProMarket undertakes to give you a refund for the price paid, the refund will be effected, where possible, using the same payment method you used to purchase the product, or by bank transfer. You shall be responsible for providing ProMarket, by email to the email address your bank details, so as to allow ProMarket to transfer the refund to your account.
